To prove your common-law status, you will need different documents such as the statutory declaration of a common-law union (IMM 5409), at Invicta Law Corporation we can help you to understand and validate this important document.
At Invicta Law we help you to understand the full document, for this, we need to ensure you read the document and be 100% sure you understand before you sign and swear the IMM5409 form.
For this process you will need to a) Indicate that you have read and understood the full document, b) Your declaration is conscientiously believing it to be true and knowing that it is of the same legal force and effect as if made under oath. c) Our notary will check your government-issued photo identification. d) You must be physically present to sign the document (although some exemptions apply and remote notarial services are allowed in some cases).
Booth parties have to sign the Statutory Declaration of Common-Law. A notary of Invicta Law Corporation will stamp and seal form IMM5409.
The Statutory Declaration of Common-Law specifically asks the parties to disclose whether they have some accounts or documents in common. When the parties do not have such documents, they can list alternative information such as: joint accounts or shared credit cards (statements), proof of shared ownership of residential property or residential leases – rental receipts, bills for shared utilities: Internet, telephone, electricity, etc. Many people lists proof of shared management of household expenses, evidence of shared purchases (household items) for example bills of Amazon or other similar services, mail addressed to either or both of you at the same address, and finally, important documents showing the same address for example driver’s licenses, insurance policies and identification documents such as BC Card.
Note that you do not necessarily have to show the actual evidence to the notary. The notary is only witnessing your attestation of the form, not reviewing the documents listed. Later on, depending how and when you are going to be using IMM5409, the burden of proof is on you to show the authorities that you have such evidence to prove the relationship. If you are using IMM5409 (statutory declaration of common-law) for an immigration process and have doubts, make an appointment with our lawyer Maria Campos to get legal advice.
